Effective date: July 28, 2026.
Provider: AXIX® di Simone Paciaroni, Italy (“AXIX”, “we”, “us”). Service: the HACCP.ai web application available at app.haccp.ai, including the API at api.haccp.ai and related documentation (the “Service”). Notices: info@haccp.ai.
1. Who may use the Service
The Service is offered exclusively to businesses and professionals operating in or serving the food safety sector (e.g. food safety consultants, quality managers). By creating an account you represent that you act in the course of a business or profession and not as a consumer, that you are at least 18, and, if you accept for a company or firm, that you have authority to bind it (“Customer”, “you”).
2. The Service: what it is and what it is not
- HACCP.ai is an AI-assisted drafting and research workspace: it generates draft HACCP plans and related documents with citations to public regulatory sources, answers regulatory questions with citations, and provides client and document management.
- Drafts only. Every generated document requires review, editing and approval by a qualified professional: you. The workflow enforces draft → review → sign: AXIX and the Service never sign, certify or approve any document.
- No professional, legal or regulatory advice. Output is informational drafting support; it creates no professional-client relationship between AXIX and you or your clients. You retain full professional responsibility for any document you sign or deliver.
- AI limitations. Despite citation grounding and quality gates, output may be incomplete, outdated or incorrect. You must independently verify regulatory references before relying on them.
- Regulatory sources indexed by the Service (FDA Food Code, FSMA, Codex Alimentarius and related public corpora) are snapshots taken at indexing time and may lag official updates.
3. Accounts
Provide accurate registration information and keep it current; safeguard your credentials; you are responsible for activity under your account. Each account is a separate tenant and may not be shared across separate firms. Notify us promptly at info@haccp.ai of any unauthorized use.
4. Customer Data and your clients
- “Customer Data” means data and documents you upload or enter, including information about your own clients. You own your Customer Data. You grant AXIX a limited, non-exclusive license to host and process it solely to provide and secure the Service, as governed by the Data Processing Agreement (“DPA”).
- You represent that you have all rights and lawful bases (including any notices or consents required from your clients) to upload Customer Data.
- Prohibited data: special categories of personal data (GDPR Art. 9), data about minors, payment card numbers, government identifiers.
- No AI training on Customer Data. Customer Data is processed at inference time only, within your isolated tenant, and is never used to train or fine-tune models.
5. Generated Output
Subject to Section 6, you own the documents generated for you by the Service (“Output”) once delivered to your workspace, and you may use, modify, white-label (where your plan includes it) and deliver them to your clients. Output may be similar to output generated for other customers from the same public sources; no exclusivity is granted. AXIX asserts no authorship claim over signed final documents you deliver.
6. AXIX intellectual property
The Service, its software, prompts, evaluation suites and the AXIX proprietary knowledge base (templates, CCP decision logic, hazard databases, operating procedures) remain the exclusive property of AXIX and its licensors. You must not: reverse engineer, scrape or bulk-extract content; attempt to extract or reconstruct the AXIX knowledge base, including via prompts designed to elicit verbatim proprietary content; resell or provide the Service to third parties as a service bureau (delivering Output to your own clients is fine); use the Service to build a competing product; or circumvent technical protection, isolation or rate-limiting measures. The AXIX figurative mark (EUTM No. 018593069) is a registered European Union trade mark of Simone Paciaroni. Product names and signs, including HACCP.ai and the AXIX word sign, are used as unregistered trademarks. No trademark license is granted except white-label rights expressly included in your plan.
7. Acceptable use
Do not use the Service in violation of applicable law; to produce documents you know to be false or misleading (e.g. fabricated monitoring records); to infringe third-party rights; or to probe, attack or disrupt the Service or other tenants. We may suspend accounts that present a security or legal risk, with notice where practicable.
8. Fees and payment
Paid plans are billed by subscription via Stripe at the prices shown at checkout, exclusive of taxes. Subscriptions renew automatically unless cancelled before renewal; fees are non-refundable except as required by law or expressly stated. Prices may change with at least 30 days’ notice, effective from the next renewal. During free early access, this section applies only once a paid plan is offered.
9. Early access (alpha/beta)
Features or the entire Service may be offered as alpha or beta (“Early Access”): provided “as is”, may change or be discontinued at any time, may contain errors, and is excluded from availability commitments. Early Access may be subject to a separate confidentiality notice. If you provide feedback, you grant AXIX a perpetual, royalty-free license to use it without restriction.
10. Data protection
Processing of personal data is governed by the Privacy Policy (for data AXIX controls) and the DPA (for Customer Data processed on your behalf). For Customer Data, the DPA prevails in case of conflict.
11. Availability and changes
We target commercially reasonable availability but offer no SLA at this stage. We may modify the Service, provided modifications do not materially degrade core functionality of a paid plan during a paid period.
12. Warranties and disclaimers
EXCEPT AS EXPRESSLY STATED, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. AXIX DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. AXIX DOES NOT WARRANT THAT OUTPUT IS ACCURATE, COMPLETE, CURRENT OR COMPLIANT WITH ANY LAW, OR THAT USE OF THE SERVICE WILL SATISFY ANY REGULATORY OBLIGATION OF YOU OR YOUR CLIENTS.
13. Limitation of liability
NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. EACH PARTY’S TOTAL AGGREGATE LIABILITY IS CAPPED AT THE FEES PAID BY CUSTOMER IN THE 12 MONTHS PRECEDING THE EVENT (OR USD 100 IF THE SERVICE WAS FREE IN THAT PERIOD). Nothing limits liability for willful misconduct, gross negligence, or liability that cannot be limited under applicable law (including Art. 1229 of the Italian Civil Code).
14. Indemnity
You will defend and indemnify AXIX against third-party claims arising from Customer Data, from documents you signed and delivered to your clients, or from your breach of Sections 4, 6 or 7. AXIX will defend and indemnify you against third-party claims that the Service (excluding Customer Data and Output as modified by you) infringes their intellectual property rights.
15. Term and termination
These Terms apply from account creation until the account is closed. Either party may terminate for material breach uncured within 15 days of notice. You may cancel your subscription at any time, effective at the end of the current billing period. Before closure you may export your Customer Data and Output; afterwards, Customer Data is deleted per the DPA, subject to legal retention duties and backup cycles.
16. General
These Terms are governed by Italian law, excluding conflict-of-law rules and the CISG; exclusive jurisdiction: the courts of Macerata, Italy. We may update these Terms with at least 30 days’ notice for material changes; continued use constitutes acceptance, and you may terminate before changes take effect if you object. You may not assign these Terms without consent; AXIX may assign to an affiliate or successor entity of the AXIX business. Entire agreement with the DPA, Privacy Policy, checkout terms and any Early Access notice; severability applies; English controls. These Terms will continue to be refined as our formal legal review completes.
